15-1.1 Definitions For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section: a- “Area” - The surface included within the framework of any sign measured from outside to outside of such framework, mounting posts not included. b- “Awning sign” – Any form of advertising on the surface of (including that affixed) any awning or shade. c- “Banner sign” – Any sign made of canvas, cloth, plastic, etc. d- “Frontage” – A section of the front of any building e- “Ground sign” – Any sign supported by uprights, etc. placed on the ground and not attached to a building f- “Marquee sign” – Any sign affixed over the entrance to any building g- “Occupant” – Person owning, renting, or occupying said property h- “Parasite sign” – Sign hung or supported on another sign but not an integral part of said sign i- “Projecting sign” – Any sign extending over public space or beyond the face of the wall of any building j- “Roof signs” -Any sign on the roof of any building k- “Sign” –Any display device or surface, including, bulletins, flyers, posters, or more permanent signage l- “Temporary sign” -Any sign with a predetermined limited usage such as for yard sale, garage sale, political campaign, special events, etc. m- “Wall sign” – Any sign erected or affixed directly upon or mounted parallel to any building wall.
15-1.2 Permit to Erect Signs a- Application Required. No sign shall be erected except as provided in this article until a permit has been issued by the Town of West Union. b- Permit application must include sign specifications including mounting specifications. Reasonable safety considerations will be approved by the Mayor and Council of the Town of West Union but liability assumption and insurance coverage is to be assumed by owner of the sign. c- No sign shall be erected that shall restrict public use of public property or promote a safety hazard such as extending beyond a wall or covering windows or other emergency exits. d- Permits not required for temporary or portable signage less than 3’ in height or length where not otherwise prohibited by ordinances of the Town of West Union. Permits shall not be required for ground signs of a temporary nature erected on personal property. e- No parasite signs shall be allowed. f- Maintenance and upkeep of signs with regard to appearance and safety shall be the responsibility of the sign owner. g- Fees: Sign permit application one-time fee shall be $5.00 h- Sign must be clearly marked as to owner of sign and date of permit i- Enlargement or alteration of sign shall require new permit application.
15-1.3 Removal of signs Temporary Signs are to be removed within 48 hours after their stated use date. (48 hours after yard sale, election, etc is over) Business advertisement signs are to be removed within 30 days of closure of business.
15-1.4 Penalties The Town of West Union reserves the right to bring signs into compliance with the above ordinance. Owners will receive a bill from the Town for costs associated with maintenance or removal. Penalty for not removing temporary sign in compliance with ordinance: $25.00
15-1.5 Town of West Union Civic Sign a- Individual advertising signs on the main West Union Civic sign, whether for businesses, fraternal organizations, non-profit organizations, etc., shall occupy a uniformly sized space on the West Union Civic Signs. b- Monthly maintenance and exhibit fees shall be determined by the Mayor and Council of the Town of West Union. c- Total number of signs allowed on the West Union Civic sign to be determined by the Mayor and Council of the Town of West Union. d- Obscenity restricted and not tolerated on the West Union Civic sign. Improper or offensive material defined by the Mayor and Council of the Town of West Union.
15-1.6 Liability The provisions of this Ordinance are severable, and in the event that any provision or part thereof shall be held invalid for any reason by any Court exercising competent jurisdiction, then such invalidity shall not be deemed to affect or impair any of the other provisions or parts of this Ordinance not specifically held to be invalid. It is hereby declared to be the intent of the Town of West Union that this Ordinance would have been adopted if any such invalid provision or part hereof had not been included herein.
15-1.7 Invalid Provisions and Inconsistent Ordinances The provisions of this Ordinance are severable, and in the event that any provision or part thereof shall be held invalid for any reason by any Court exercising competent jurisdiction, then such invalidity shall not be deemed to affect or impair any of the other provisions or parts of this Ordinance not specifically held to be invalid. It is hereby declared to be the intent of the Town of West Union that this Ordinance would have been adopted if any such invalid provision or part hereof had not been included herein. All other ordinances or parts of ordinances in conflict with provisions herein are hereby repealed. 15-1.8 Effective Date This Ordinance shall be deemed effective thirty (30) days following the second (2nd) reading, passage and adoption by the Council of the Town of West Union.
