Curfew Ordinance for the Town of West Union

13-1.1   Definitions

For the purposes of this article, the following words and phrases shall have the meanings respectively ascribed to them by this section:

a- Minor any person under the age of eighteen

b- Legal guardian is a court appointed custodian of a minor child.

 13-1.2   Prohibited conditions

a- No minor under the age of eighteen years shall loiter, idle, or wander unsupervised between the hours of 11:00 PM and 6:00 AM.  A minor who is legally employed and engaged in the duties of employment or going to or from such place of employment shall be exempted from this prohibition.

b- No minor under the age of fifteen years shall loiter, idle, or wander unsupervised between the hours of 10:00 PM and 6:00 AM.  A minor who is legally employed and engaged in the duties of employment or going to or from such place of employment shall be exempted from this prohibition.

 

13-1.3   Compliance Required

a- Any minor violating the provisions of this section shall be deemed a delinquent child under  the provisions of State Law and shall be dealt with as such under the provisions of State Law.

b- The parent of any child and the guardian of any ward shall not authorize or knowingly permit any such child or ward to violate any of the provisions of this article. 

 

 13-1.4   Penalties

            a- Whoever violates the provisions of this article, whether it be the minor, or the parent or     guardian, shall be subject to a fine of not more than two hundred dollars ($200.00) or imprisoned not more than thirty days, or both.

            b- Reporting of the child as a delinquent child shall be made by the Town of West Union in accordance with State law.

 
13-1.5   Liability

The provisions of this Ordinance are severable, and in the event that any provision or part thereof shall be held invalid for any reason by any Court exercising competent jurisdiction, then such invalidity shall not be deemed to affect or impair any of the other provisions or parts of this Ordinance not specifically held to be invalid.  It is hereby declared to be the intent of the Town of West Union that this Ordinance would have been adopted if any such invalid provision or part hereof had not been included herein.

 

13-1.6   Invalid Provisions and Inconsistent Ordinances

The provisions of this Ordinance are severable, and in the event that any provision or part thereof shall be held invalid for any reason by any Court exercising competent jurisdiction, then such invalidity shall not be deemed to affect or impair any of the other provisions or parts of this Ordinance not specifically held to be invalid.  It is hereby declared to be the intent of the Town of West Union that this Ordinance would have been adopted if any such invalid provision or part hereof had not been included herein.

All other ordinances or parts of ordinances in conflict with provisions herein are hereby repealed.
 

13-1.7   Effective Date

This Ordinance shall be deemed effective thirty (30) days following the second (2nd) reading, passage and adoption by the Council of the Town of West Union.  (Passed:  September 4, 2007.  Adopted October 2, 2007.
